CAR PARK TERMS AND CONDITIONS

Definitions

When the following words are used in these Terms and Conditions (the “Terms”), this is what they will mean:

Us”, “We” and “Our” means Total Car Parks Limited (TCP), Company number 06449496 whose registered office is Suite 255, Communications House, 9 St Johns Street, Colchester CO2 7NN;

You”, “Your”, “Owner” “Driver” means the person (driver) parking on the Car Park.

ANPR” means Automatic Number Plate Recognition;

Car Park” means the parking facilities in the area and/or building managed by (or on behalf of) us and designated for parking vehicles;

Bookings Provider” means the provider used by Us and offering Online and Pay by Mobile facilities for Our customers on the Car Park. Customers using this method will not have to display anything in the windscreen of the vehicle nominated to park on the Car Park for the duration of their parking session.

Parking Receipt” means the ticket issued by the Pay & Display machine confirming your parking session.

 “Vehicle” means any vehicle used to convey passengers or items that enters the Car Park, including any mechanical device on wheels or tracks, its equipment and accessories; and

VRM” means Vehicle Registration Mark.

1.              General

(a)        Online / Pay by Mobile payments for your parking will not entitle you, unless otherwise specified, to any particular space in the Car Park or priority over other customers. Upon entry to the Car Park, if you are unable to find a space for your vehicle then please exit immediately to avoid being issued with a Parking Ticket Charge Notice.

(b)        However, in the unlikely event that a customer in receipt of a valid parking session cannot locate a space, we will endeavour to reassign this parking session to another of our car parks nearby and where a parking space is available. You need JavaScript enabled to view it. to request a refund or a reassignment of your parking session (see VRM/Date Amendments and Refund Policy).

(d)        We reserve the right to amend, at any time, our Car Park Terms and Conditions. 

2.              VRM/Date Amendments

(a)            The majority of online and pay by mobile parking sessions are made through our bookings provider.  You will be able to amend your VRM details in real time using the account you will have set up to make your booking.  If you need to move the actual date of your parking session then please follow steps b) and c) below.

(b)            Any amendments to your VRM in respect of any manual contract parking arrangement with Us, and not through our bookings provider, should be made by contacting our administration department during office opening hours on 0345 293 0818 or E This email address is being protected from spambots. You need JavaScript enabled to view it..  Please give us at least 24 hours' notice in writing in order to amend existing bookings.   

(c)            Once you have supplied us with your VRM and the amended dates/times you wish to be actioned, we will send you an email confirming the amendment.   Failure to notify us of any amendments may result in a Parking Ticket Charge Notice being issued to any vehicle incorrectly registered to park on any Car Park.

3.              Refund Policy

(a)            We will endeavour to refund any paid parking session on the Car Park for which you are able to provide valid evidence of your vehicle being parked elsewhere for the entirety of your booking. Refund requests must be made within 7 days from the last date of your paid parking session; any request made after this time will be declined without consideration.

(b)            If you are requesting a refund for a weekly, monthly or quarterly parking session, and the parking session on the Car Park in question has already commenced, you will be charged at the full day/24 hour rate for each day already used on your parking session, including the day the request has been made, and you will incur an additional administration fee of £10.00 or 10% of the value of the payment made for the parking session, whichever is the highest.

(c)            If you have created a duplicate transaction whilst making payment for your parking session we will offer to reassign your parking session for use at a later date.  Please contact us immediately, during office opening hours. 

(d)            We reserve the right to cancel and refund any parking session if we find an error has been made in the provision of this parking session or due to circumstances beyond our control such as Car Park closure.

4.              Driver’s Possessions

Vehicles and their contents are left entirely at the risk of the owner/driver. No liability can or will be accepted by Total Car Parks Ltd or the land owner or other interested parties for any loss, damage, distress or injury incurred however caused.

5.              Safety in the Car Park

For safety reasons you are not entitled to remain in your vehicle in the Car Park or elsewhere in the Car Park except for the purposes of parking or removing your vehicle. After you have parked your vehicle, you must proceed immediately to the nearest exit, following the recommended route (if any). You must not, in any circumstances, exit the Car Park by walking under a vehicle exit barrier.

6.              Traffic Orders and Byelaws

The use of this Car Park may be regulated by traffic orders or byelaws under which a penalty may be payable for failing to comply with these Terms or the requirements of the relevant order or byelaw. In such circumstances, separate notices specifying the relevant order or byelaw will be displayed in the Car Park and we reserve the right to take enforcement action against you (including through court proceedings) for breach of such order or byelaws.

7.              Parking Terms & Conditions and Contraventions

Please see the notices on site for further details, these are visible on all Our Car Parks.

By parking your vehicle in this car park you agree to these Terms & Conditions.

  • Do not park as to cause obstruction or inconvenience to others
  • Parking permits or any authorisation for parking must be valid and clearly displayed
  • When a designated bay or space has been issued you must park within that car parking space
  • Permit-less parking must be valid; any change of vehicle must be updated prior to parking
  • Pay & Display Machine: Parking Receipt must be clearly displayed inside the windscreen of the vehicle with date and time on view. If this is not possible to do, then you must book and pay online or pay by mobile.  Parking Receipts are not transferable. 
  • ANPR: when using the Pay & Display machine you will be requested to enter the relevant VRM details, the Parking Receipt does not have to be displayed inside the windscreen of the vehicle. Any VRM incorrectly entered into our P&D machine may incur a Parking Ticket Charge as a result.
  • By parking your vehicle in the Car Park you consent to us capturing, using and processing your VRM and personal details via CCTV and ANPR for enforcement purposes, to calculate the relevant parking tariff (if applicable) and to recover any outstanding Parking Ticket Charge. This includes our right to request and obtain the details of a vehicle’s registered keeper from the DVLA.  
  • Pay by Mobile (no Parking Receipt):Follow the instructions provided on the pay by mobile sign(s).
  • Online Parking Payments (no Parking Receipt required): Follow the instructions provided on the website.
  • Bookings made by Pay by Mobile/Website are only valid for the car park for which they have been booked.
  • The Blue Badge Scheme is not operated on our Car Parks, parking in disabled bays must be accompanied by a valid payment, unless otherwise stated on the notices onsite.

Failure to comply with the Terms & Conditions will result in the following enforcement procedure as advertised on the signs throughout the car park:

The Vehicle being issued a parking ticket charge fee £100.00 (IF PAID WITHIN 7 DAYS REDUCED TO £30.00 IF PAID WITHIN 14 DAYS REDUCED TO £60.00)

LATE PAYMENT: Failure to pay the parking ticket within 28 days from date of issue may result in Registered Keeper details being requested from the DVLA and a request for a payment of £150.00 forwarded to; DEBT RECOVERY AGENCY for collection or court enforcement. This will incur further administration and legal fees that you will be liable for.

  • State the PTCN No. and your address on the back of your cheque.

8.              Appeals

(a)            If you wish to appeal against a Parking Ticket Charge Notice, you must do so within 28 days of the date of Notice or within the time period stipulated in the notice/document you received.

(b)            You can appeal using the online form or by sending your appeal to the PTC Processing Department, Suite 255, Communications House, 9 St Johns Street, Colchester, Essex, CO2 7NN.

(c)            All appeals must include Full Name, Address, Vehicle Registration and the Parking Ticket Charge Notice Number; only appeal ONE Parking Ticket Charge Notice at a time, to appeal more than one Parking Ticket Charge Notice please fill in the form again stated on the website www.totalcarparks.co.uk/appeal

(d)            The Parking Ticket Charge discount will be frozen from the date the Appeal has been received, we aim to respond in writing or by email within 14 working days. If you have supplied an e-mail address, you will be notified as to the outcome of your appeal by e-mail. Therefore, please ensure that your e-mail address is serviceable. Please check your Junk E-mail folder in case a response to your appeal has been delivered there instead of your Inbox.

(e)            If your appeal is not upheld, then you will be eligible to use the Independent Appeals Service POPLA, details will be made available at the appropriate time.

(f)             Appeals cannot be considered over the telephone or by sending an e-mail, we currently only accept Appeals sent using the online form on Our website or sent to us by post.

 

We will not accept an Appeal either in writing or on-line if payment has been made for a Parking Ticket Charge Notice, as liability has then been accepted for the Parking Ticket Charge Notice.

 

9.              Access and re-location of vehicles

(a)            We reserve the right to refuse the admission of any vehicle to the Car Park for any reason whatsoever.

(b)            We reserve the right to move vehicles within the Car Park using whatever method we consider appropriate (even if, as a consequence, damage is caused to your vehicle) to the extent that is reasonably necessary for the purposes of safety to persons or property, or to avoid obstruction at the Car Park.

(c)            We additionally reserve the right to use a private company or  lawful authority to remove any vehicle to another reasonably convenient car park, whether or not operated by us, where the Car Park has to be unexpectedly closed permanently or temporarily, either in whole or in part, due to a matter outside of our control, or if the Car Park has to be evacuated in an emergency.

(d)            To the extent that it is necessary to do so in the exercise of the rights conferred upon us in this clause 9, we reserve the right to drive or otherwise take your vehicle onto a public highway. In doing so we will take reasonable care of the vehicle.

 

10.           Abandoned vehicles

(a)            We are entitled to regard as abandoned any vehicle left in the Car Park for more than 7 days without prior notification and which is not known by us to be covered by a valid parking session, or authorisation to park.

(b)            We reserve the rights to engage and/or permit a lawful authority to remove (or where we are unable to identify the current legal registered keeper of the vehicle, to take steps ourselves to remove) and to dispose of as waste or sell any abandoned vehicle.  Before proceeding with the disposal or sale of abandoned vehicles we will:

(i)       refer the matter to the appropriate authorities, which may include the local police and the DVLA; and

(ii)     affix a notice to the vehicle at least 7 days before the date on which we propose to remove the vehicle stating that the vehicle will be removed and sold when that period expires.

(c)            Abandoned vehicles will be disposed of as waste or sold by auction.  Where sold by us, the proceeds of sale will be applied in and towards satisfaction of all sums owing to us together with the expenses of sale and our reasonable storage and removal costs for the period during which the vehicle is in our possession.

(d)            Any balance of the sale proceeds remaining after satisfaction of any sums owing will be held by us on behalf of the registered keeper of the vehicle and paid over on proof of entitlement.

 

11.           Prohibited activities

(a)            You must not tow any vehicle into the Car Park except as part of the services offered at the Car Park by persons authorised by us and no work on and no cleaning of vehicles by you or your agent, other than with our prior specific permission, is permitted in the Car Park. In the event of vehicle breakdown you must contact the Car Park attendant or our office during opening hours to ensure that your vehicle removal or repair is organised without causing disruption, damage or danger to any other person or property in the Car Park.

(b)            No activity in connection with the selling, hiring or other disposal of vehicles or goods or services may be carried out in the Car Park without our prior specific written permission.

(c)            You are not allowed to dispose of any items or drop litter in the Car Park. Please place any rubbish/litter in the bins that are provided or take it away with you when you leave the Car Park.

(d)            You are not allowed to pour petrol, or any other fuel, into your vehicle whilst it is in the Car Park. You are also not allowed to take petrol, or any other fuel, out of your vehicle whilst it is in the Car Park.

(e)            Smoking is forbidden within both the Car Park and the immediate vicinity of the Car Park.

(f)             Anti-social behaviour will not be accepted in our Car Parks. This includes (but is not limited to) abusive behaviour towards our staff, drinking alcohol, taking or dealing with illegal substances, fighting and/or loitering.  Car parks are designed for the sole purpose of parking vehicles. If an individual causes a nuisance or disturbance to others it may be recorded by CCTV cameras and action may be taken against them.

12.           General

Each of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
